**According to the 2023 FDD, the Development Incentive Program offer depends on the opening date of a restaurant. The royalty fee will equal the following amounts: (1) for restaurants opened at least 60 days prior to the scheduled opening date, we will not charge a royalty fee for the first six months after the opening date of the restaurant;
(2) for restaurants opened at least 30 days prior to the scheduled opening date, we will not charge a royalty fee for the first five months after the opening date of the restaurant;
(3) for restaurants opened no more than 90 days after the scheduled opening date, we will not charge a royalty fee for the first four months after the opening date of the restaurant;
(4) for restaurants opened no more than 150 days after the scheduled opening date, we will not charge a royalty fee for the first three months after the opening date of the restaurant; and
(5) for restaurants opened more than 150 days after the scheduled opening date, we will begin charging a royalty fee on the opening date of the restaurant.
† The average unit volume and EBITDAR amounts are for the top third of company restaurants open at least one full year as of the 2022 fiscal year-end. The company EBITDAR does not include a 4.5% royalty fee paid by franchisees, which would reduce the EBITDAR to $313,492.
